Exemption

The first $25,000 of assessed value per location is exempt; tax applies to value above that. After an initial return, the annual return is waived while value stays at or under $25,000.

Tax yearsAmountTypeStatute
2008–present$25,000deductionFla. Stat. § 196.183

Created by s. 8, ch. 2007-339 and s. 9, ch. 2008-173 implementing Amendment 1 (approved by voters January 29, 2008); first applied to the 2008 tax roll.

SINGLE RETURN PER SITE: 196.183(1) — "A single return must be filed for each site in the county where the owner of tangible personal property transacts business." Owners of freestanding property at multiple sites that are not business sites (vending machines, LP tanks, utility/leased equipment) file ONE return covering all such property in the county and receive one exemption for it.

Penalties

  • Late return: 5% of the tax for each month (or part) it is late, capped at 25%.
  • No return filed: 25% of the tax.
  • Property omitted from a return: 15% of the tax on the omitted property.

F.S. 193.072 (2026 Florida Statutes; History s. 13, ch. 70-243; s. 1, ch. 77-102; s. 9, ch. 79-334; s. 972, ch. 95-147).

Penalties are a percentage of the ad valorem tax ultimately levied on the property, not of value: late return = 5% of tax per month or part-month late, capped at 25% (filed in April = 5%, May = 10%, June = 15%, July = 20%, August 1 or later = 25%); no return = 25% of tax each year; unlisted property = 15% of the tax attributable to it. 193.072(2): penalties are computed on all ad valorem personal property taxes, penalties and interest levied on the property and are a lien on the property.

Notes

Florida has no state-level return; the DR-405 (DOR form incorporated by Rule 12D-16.002, F.A.C.) is filed with the county property appraiser in each county where property is located as of January 1 (F.S. 193.052/193.062). Several appraisers issue county-branded versions (e.g., HC-405 Hillsborough, PC-405 Pinellas, VC-405 Volusia) with the same lines.

Statute year: text verified against the 2026 Florida Statutes on m.flsenate.gov for 193.062, 193.063, 193.072, 194.011, 197.162 and 197.333; 196.183 verified on the 2024 (incl. 2025C) page plus the 2025 Chapter 196 text (unchanged since ch. 2008-173); 192.001 verified on the 2025 Chapter 192 text.

The DOR TPP page (floridarevenue.com/property/Pages/Taxpayers_TangiblePersonalProperty.aspx) says the DR-405 is due to the county property appraiser by April 1 and that returns filed after April 1 or after an approved extension are not timely; DOR brochure PT-114 at floridarevenue.com/property/Documents/pt114.pdf.
